Venezianico S.r.l., with its registered and operational office at Corso Silvio Trentin 76, San Donà di Piave (VE) – 30027, VAT no. 04427770278 (hereinafter referred to as the "Data Controller"), owner of the website https://www.venezianico.com (hereinafter referred to as the "Website"), in its capacity as the Data Controller of the personal data of Users who browse and who may also be registered on the Website (hereinafter also referred to as the "Users" or "Data Subjects"), provides the following privacy policy in accordance with Article 13 of EU Regulation 2016/679 (hereinafter also referred to as the "Regulation" or "Applicable Legislation" or "GDPR").

It is hereby clarified that some of the data processing activities governed by this Privacy Policy also apply to Customers who physically visit the "VENEZIANICO ATELIER" store located at Corso Silvio Trentin 76, San Donà di Piave (VE): when purchasing one of our products, we offer new Customers the option to register on the Shopify platform (the same platform used for online purchases), and also specify that their email address will be used for future email marketing activities.

It is further clarified that this Website and the services offered through it are reserved for individuals who are at least eighteen years of age: the Data Controller does not collect personal data relating to individuals under the age of 18. In any case, upon specific request, the Data Controller will promptly delete any personal data inadvertently collected relating to individuals under the age of 18.

The Data Controller places the utmost importance on the right to privacy and the protection of personal data of its Users: for any information regarding this privacy policy, Users can contact the Data Controller at any time, including using the methods described in section 4.

1. Purpose of Data Processing

The personal data of the Users will be processed lawfully by the Data Controller pursuant to Article 6 of the Regulation for the following purposes:

  • a) Website Navigation:To detect technical data of the User (e.g., IP address) during website navigation, which is necessary at a technical level (so-called technical cookies); regarding other cookies installed on our site, please refer to the cookie policy available on our site.
  • b) Sending newsletters or other informational-advertising material to non-Customers(in this case, the legal basis for processing is the consent of the Data Subject, GDPR Art. 6, paragraph 1, letter a).
  • c) Responding to information requestsreceived by the Data Controller through the appropriate contact form or other methods (e.g., by phone or email). (In this case, the legal basis for processing is the necessity to fulfill a request from the Data Subject, GDPR Art. 6, paragraph 1, letter b).
  • d) Registration on the reserved area of the website(to monitor online purchases, order history, order status, etc.). (In this case, the legal basis for processing is the necessity to fulfill a request from the Data Subject, GDPR Art. 6, paragraph 1, letter b).
  • e) Legal obligations:To comply with obligations required by law, an authority, a regulation, or European legislation. (In this case, the legal basis for processing is the necessity to comply with legal obligations, GDPR Art. 6, paragraph 1, letter c).
  • f) Contractual obligations and service provisionin case of online purchases or at our store located at Corso Silvio Trentin 76, San Donà di Piave (VE), to execute the General Conditions of Sale (accepted by the User during registration on the Website) and to fulfill, also through our customer care, specific requests from the Customer. (In this case, the legal basis for processing is the necessity to execute the contract and the requests of the Data Subject, GDPR Art. 6, paragraph 1, letter b).

The data collected from the User/Customer by the Data Controller for the purpose of their registration on the Website includes: Mandatory: Email, Password, Name, Surname, Shipping Address, Postal Code, City, Province, Country, Phone Number. Personal data will also be used by the Data Controller to verify the identity of the Data Subject (through email validation), thus preventing possible fraud or abuse, and to contact the User/Customer for service-related reasons (e.g., sending notifications related to order status).

  • g) Administrative-accounting purposesto perform organizational, administrative, financial, and accounting activities functional to the fulfillment of contractual and pre-contractual obligations; (in this case, the legal basis for processing is the necessity to comply with legal obligations, GDPR Art. 6, paragraph 1, letter c).
  • h) Sending "soft spam" commercial communications,meaning the Data Controller will send commercial communications regarding products related to those already purchased, to the email addresses used for those purchases (in this case, the legal basis for processing is the combined provisions of Article 130, paragraph 4, of Legislative Decree 196/2003, as amended, and Article 6, paragraph 1, letter f of the GDPR – legitimate interest).
  • i) Klarna payment method.To offer the User/Customer Klarna payment methods at checkout, we may transmit personal data to Klarna. The personal data transferred will be processed in line with Klarna's privacy policy. (In this case, by opting for this payment method, the User/Customer consents to the transmission of their personal data to Klarna).

With the exception of technical cookies (the installation of which is automatic and independent of the User's will, as they are absolutely necessary to enable the functioning of the website itself) and other cookies (the installation of which is at the User's discretion and does not prevent website registration or use of the purchase service), the provision of personal data for contractual/service provision purposes is optional but necessary, as failure to provide such data would make it impossible for the Data Controller to fulfill the Customer's requests (online purchase, customer care, Klarna payment, etc.).

2. Methods of Processing and Data Retention Period

The Data Controller will process Users' personal data using manual and IT tools, with logic strictly related to the purposes themselves, and in any case, in a manner that ensures the security and confidentiality of the data.

The personal data of Website Users will be retained for the time strictly necessary to fulfill the purposes described in paragraph 1 above, or in any case as required to protect the interests of both Users and the Data Controller in civil law matters. Concerning the purposes referred to in points 1.b and 1.h, the data will be retained until you object to the sending of the newsletter through the appropriate link contained therein or through the exercise of your rights as outlined in paragraph 4.

3. Scope of Data Communication and Dissemination

Employees and/or collaborators of the Data Controller, who are tasked with managing the Website and/or sales operations of our products and/or customer care, may become aware of Users' personal data. These individuals, formally appointed by the Data Controller as “Persons authorised to process personal data” will process the data of the Data Subjects exclusively for the purposes indicated in this privacy notice and in compliance with the provisions of the Applicable Legislation. Third parties who process personal data on behalf of the Data Controller as "Data Processors," such as IT and logistics service providers, outsourcing or cloud computing service providers, professionals, and consultants, may also become aware of Users' personal data. The data may also be communicated to the Tax Administration and/or other public authorities where required by law or upon their request. Data Subjects have the right to obtain a list of the Data Processors appointed by the Data Controller by making a request to the Data Controller using the methods indicated in the following paragraph 4.

4. Rights of Data Subjects

Data Subjects may exercise the rights granted to them by the Applicable Legislation, including the right to request from the Data Controller access to their personal data, rectification, or deletion of the same, limitation of the processing of personal data concerning them, or to object to their processing, or the right to lodge a complaint with the Privacy Authority .
